Приведу этот пассаж полностью: «The obstacles to the passage of laws which render a power to repeal inferior to an opportunity of rejecting, as a security against oppression, would here render an opportunity of rejecting an insecure provision against anarchy». Перевести это трудно. Ведь Мэдисон обсуждает чисто гипотетическую ситуацию, так что даже доскональное знание американских реалий не гарантирует нам точного понимания его соображений. В правовой системе США право собственности, которым обладало с какого-то момента физическое или юридическое лицо, обычно не ограничивается никаким сроком, а существует неопределенно долго. Но это право может быть аннулировано более поздним правовым актом, например сделкой купли-продажи. Применительно к такой реальной ситуации, наверное, можно сказать, что более поздний акт «выше» более раннего. По-видимому, Мэдисон предполагал, что установление для всех законов предельного 19-летнего срока действия упразднило бы такую «естественную» вертикаль и что законодатели попытались бы встроить принимаемые ими законы в вертикаль новую, искусственно создаваемую.
