Однако на пути к пониманию стояло много проблем, разрешение которых усложнило ход Славной революции и на некоторое время старые споры о формуле власти вспыхнули с новой силой. Эпизоды, связанные с двойным отстранением Якова II, создавали угрозу того «казуса междуцарствия», которая сама по себе несла политическую нестабильность. Проблема неизбежного насилия как фактора Славной революции предстала в двух ипостасях: во-первых, вооруженное вторжение в качестве средства решения политических задач, и оно было единодушно одобрено на протяжении декабря 1688 г. тремя собраниями лордов, общин и городского совета, собранных Вильгельмом Оранским по прибытии в Лондон. Во-вторых, в виде лишения трона законного короля Якова II, что потребовало новой формулы перехода власти. Норма правового обеспечения данной процедуры требовала созыва парламента королем, но на данном этапе отсутствовали обе ветви власти. Переходной ступенью стало приглашение бывших членов вигских парламентов, которые от имени палаты общин обратились к принцу Оранскому с просьбой созвать Конвент, структура которого соответствовала традиционному парламенту. Бегство Якова II фактически освободило трон, но не решало вопрос де-юре о статусе новых претендентов. Хотя многие его сторонники перешли на сторону завоевателя, риск получить монарха по выбору, еще опаснее – республику, настораживал политические группировки разных оттенков.
